#1 Jack Smith wasn't appointed as a US Attorney, he was appointed as a Special Prosecutor.

#2 Jack Smith was dismissed by a court because he wasn't Senate confirmed.

How are the laws that allow a situation in which the executive finds itself in a position that it cannot fill an executive slot even Constitutional? So much for separation of powers.

The Constitution (Article II, Section 2) requires Senate advise and consent on filling vacancies for "Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States whose Appointments are not herein otherwise provided for, and which shall be established by Law: "
