They were sworn in 24 hours prior to the ambush.

The NG involved are brought together and all sworn in as Special Deputy U.S. Marshals.

That was the swearing in part. They were already WVNG members, not just sworn in as such.

This is the same as when local PD and SO are sworn in to work on federal task Forces or to assist other federal agencies.

The DOJ uses that option to cover all involved and then any assault / crime against them fall under federal law /1811 protection status.
