Amendment XIV, Section 1, Clause 1:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
Aliens and diplomats are NOT subject to U.S. jurisdiction.
Oh but they are, hence the problem. What you believe the Supreme Court does not, which ***** you good and hard...
It all revolves around how one defines 'jurisdiction' within a context or framework of valid residency.
Change the interpretation of 'jurisdiction' in this context and the barriers drop at the speed of light.
It remains to be seen whether that can be accomplished.
Although, it is beginning to look as though twe might learn the answer to that question in the not-too-distant future.
