The judge made some findings of fact based on some evidence in order to then apply the law as he understands the law.

In this universe, of course, a decision to dismiss on a motion for summary judgment does end the case… unless and until that decision is reversed on appeal.

A higher court (or two) will decide if the summary judgment granting dismissal was legally proper or not. All your wishful thinking won’t mean anything on appeal. If it is overruled, the cases will be reinstated on the calendar for trial. (Unless they also reverse the denial of Sandman’s motion for summary judgment in which case he wins and the five defendants will lose. That would only leave a question of how much in damages. That entails either a limited trial on the damages or maybe a round of settlements.)
