Yes, if you are handling real guns, every gun is loaded. Always. And it is never pointed at something live unless you intend to kill it. But this is an actor on a movie set, expecting that he is handling a fake gun, or at least a cold gun. To call someone in this circumstance a murderer is ridiculous.

She was a cinematographer, and a POV shot where a shooting victim watches the gun go off when pointed at him would be a plausible reason for him to do it. Not saying that's what happened, but it's a legit reason for him to shoot at her. I don't think it was murder, but the armorer got 18 months for it, which is appropriate. He should certainly not, however, be allowed to handle firearms on set without proper training on making absolutely sure he knows what's going to happen when he pulls the trigger.
