Yes the Constitution and United States Code allow for the AG to hire attorney's to prosecute cases without Senate confirmation.

Go figure. Every other Judge that has looked at the AG hiring power in the last 50 years has upheld such people in such jobs. But only Judge Canon in her infinite wisdom decided he needed Senate approval.
