Let me explain it to you: The Democratic Senate has refused to establish a joint committee with the House that could subpoena and prosecute, if warranted, Mr. Holder. This will change if the GOP wins the Senate. However, by resigning NOW, Holder will become a private citizen with 5th Amendment rights not to testify and his successor will be able to claim that he has no knowledge of his predecessor's actions.

Further note: Holder will stay on until his successor is confirmed by the Senate. That means this is nothing more than a political ploy to influence the upcoming election ("First Black AG forced out by racist GOP") without any actual significance: He could still remain in office for the next two years.
