So, the purpose of the Judiciary is to keep the Legislative and Executive branch in check when the go BEYOND the Constitutional limits. In other words, someone has to have standing in a court and make a claim that some government agency is breaking the Constitution.

The Executive, exercising long standing and Constituional power, does not fall under the Judiciary.

Those who brought the lawsuit against the Executive have not made any attempt, as far as I can see, to state that they are outside the Constitution.

Therefore, we have no crisis because the Federal Judge stepped outside his authority.
