Sure they would. As the majority of Americans doesn't necessarily mean the majority of a given state. Equal protection under the law isn't up for a vote. The judiciary is involved for the same reason that interracial marriage bans were challenged in court: the state violated the rights of individuals with their unconstitutional marriage laws.

And with 44 of 46 rulings in favor of gay marriage, its ludicrously clear that gays and lesbians advocate a constitutionally sound position.
