Wrong again, as usual. In BOUMEDIENE v. BUSH the Court held that the Guantanamo detainees are entitled to challenge their detention, they have habeas and basic due process rights. Due process rights are predicated on being a person, not a citizen alone.

And as noted, it’s un-Constitutional. The detainees are entitled to a presumption of innocence.

The murder of Daniel Pearl has nothing to do with the status of the Guantanamo detainees, unless there’s evidence one or more of them committed the crime. Then that individual or those individuals alone should be prosecuted.

The real evil in the world is Americans surrendering their freedom for security, turning away from he fundamental principles that guarantee our civil liberties. Remaining true to the doctrine of due process has noting to do with being a ‘Marxist’ or ‘Socialist,’ it’s an understanding that in order for the Constitution to have any force or meaning, it must be applied consistently, and extends even to our enemies.

We are a nation of laws. One of our most cherished documents is the Bill of Rights which guarantees the right to a speedy trial, right to see the evidence against you and right to face your accuser

We, as a nation have done none of that and hold men who are "suspected" of being terrorists in indefinite detention. Isn't it time to put up or shut up and either try or release these men?

In war you don't put people on trial. Once they become POWs they have a right to be treated fairly, but they must not be allowed to take up arms against this country again as long as they live.

If proof exists of criminal acts they must be tried and executed. If not, releasing them is the same as giving aid and comfort to the enemy. Anyone who advocates such a thing is siding with the enemy.

The conceit that this is a war is the core deception of the neo-con agenda. They've done this to justify ignoring the basic concepts of limited government. In a real war, we are prepared to temporarily suspend normal limitations on government to protect our sovereignty - to protect us from invasion.

But the GWOT, isn't a war. There's no army attacking us, no nation that is our enemy. There is no way to negotiate a meaningful surrender and no definable objective. It's a scam to justify making temporary war powers permanent. It's an end run around constitutionally limited government and proves the dangerous hypocrisy of the so-called 'conservatives' that support it.
