What it will be used as is a mitigating circumstance, possibly to route the offender to a treatment facility instead of a prison. While on the face this may not seem to be issue, the laws have to be re-written to make sure the person can never leave such facility until it can be proven beyond a shadow of a doubt that the person is zero threat. Since with most pedophiles this is impossible, the facility basically has to be a prison, and the person needs to be locked away for life.

Hopefully, however once it is allowed as mitigation, the only mitigation you could go for is not forcing then into a general prison, rather into a "treatment facility." Again as long as the laws are written to make the stay a permanent one, it wouldn't be an issue.

What an inane hypothetical. One, what does answering it prove? Also how can this be answered without knowing if the son is of age and can legally enter contracts, if the son is even the biological child of the mother, if there is any sort of coercion going on and etc.
