Rash decisions are to be avoided. That is plainly true.

But even attempting to take emotion out of "real justice" is a bad idea.

We aren't computers and we aren't "Vulcans." And for the very reason that retribution is a valid part of the criminal justice system, emotions are an integral component of justice itself.

It would, of course, be a mistake to permit emotion to run unfettered. But it would also be a mistake to root it out altogether.

Why?

It's impossible to avoid some emotion, because we're humans. But it should be strived for.

No it shouldn't be strived for. THAT is the huge mistake. Human beings are motivated in many ways and an emotional reaction to the horror of what some pedophile bastard has done is one appropriate for all concerned. A jury SHOULD be able to weigh the evidence to determine if the accused is the offender, but it should also be permitted to employ emotion to make it a bit easier to say to a fellow human being, "yes, even if you seem like a good guy, I vote to condemn you."

Why would you want to eliminate emotion from the search for truth and justice. It sounds like you think emotion somehow prevents humans from judging fairly and accurately. But that belief is not well founded. Too much emotion may lead to adverse consequences. But so too could too little emotion.
