Well, part of the logic has to do with the fact that there was no Arab Palestinian sovereignty to lay a political claim to the territory in question. AND no Arab Palestinian organization (no informal political subdivisions • otherwise) even considered opening a set of negotiation.
Israel did not occupy any sovereign Arab Palestinian Territory. Nor did Israel incorporate any sovereign territory of the Arab Palestinian. The question becomes:Every State has the duty to refrain from the threat or use of force to violate
the existing international boundaries of another State or as a means of
solving international disputes, including territorial disputes and problems
concerning frontiers of States.
IF the Arab Palestinian had no functional government or position from
which to argue their soverenty was injured, THEN who should make the
claim of a political injury?
