The judge needs to be thrown off the bench and disbarred for violating the preacher’s right to free speech. If the judge can’t grasp the 1st Amendment, he has no business overseeing a courtroom. I noticed the author of the article refuses to state the name of the judge. Time to do a little research on the judge.

The entire POINT to the 1st Amendment is that we have the RIGHT to hear views we do not agree with so long as we also have the right to hear other views which might prove them wrong!

Apparently this judge doesn't understand the constitution.
Agreed. The judge needs to be thrown off the bench and disbarred for violating the preacher’s right to free speech. If the judge can’t grasp the 1st Amendment, he has no business overseeing a courtroom.

First Amendment:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;
Well, we've already passed that barrier.

or abridging the freedom of speech, or of the press;
And we can throw that out now with the Dominion suit. At the very least, didn't Dominion have a right to get on the air, ask Fox for equal time to rebuttal whatever and whoever they didn't agree with and refute the claims with proof? Wouldn't that make more sense than just handing 3/4 billion to a company that cried: "We were hurt?"

or the right of the people peaceably to assemble,
Gave that up with Covid.

and to petition the Government for a redress of grievances.
We tried that on J6 and the fascists arrested them all then violated all of the rest of their rights in prison.

And the government did nothing, the lawyers balked and the people celebrated.

So this asshole is promulgating violence against gays online. Hate speech.

Keep him off line.

Looks to me it's over far more than a bible quote on the internet.

Leaders of Oklahomans for Equality Bartlesville also say Penkoski harassed them. A Washington County judge granted a temporary protective order against Penkoski for protesting the Bartlesville Pride event, which Oklahomans for Equality Bartlesville hosted, shouting “vulgar and obscene things” while holding a sign that read “Got AIDS Yet” as well as making a threatening Facebook post that he has since deleted, according to court records.

Maybe we need to see the context of the post before making judgement?

From your link,

"Religious individuals have a clear First Amendment right to publicly cite Bible verses that reflect their concerns about moral issues of the day without being accused of stalking, harassing, or terrorizing those who are offended by the sentiments," said constitutional attorney John W. Whitehead, president of The Rutherford Institute.
He warned, "This case is a foreshadowing of the government's efforts to insulate the populace from all things that might cause offense by criminalizing nonviolent First Amendment activities (speech, thought, and actions) perceived as politically incorrect."

This appears to be Rich

So long as democrats view the DNC morality superior to all other morality, including the Bible, this will continue.

To be a democrat means agreeing that the party morality is infallible, and to question it constitutes heresy that threatens social justice, democracy, and the American way.

To suggest that the morality of the party could be wrong in any way is blasphemy.

There is no god to serve. The Framers knew the dangers of church-and-state copulations. Jefferson's wall also stands as a testament of the freedom from religion.

A local government was going to enact an official religion. Jefferson stated the Federal government could not stop them. That's hardly a freedom of religion.

A good buffer for Whitehead's above claims is to read Seidel, The Founding Myth: Why Christian Nationalism is Un-American. One major reason to read Seidel is that the Framers also allowed for atheism, and there is no other religion worldwide that can hold a candle to xianity for its ability to secrete atheism.
