Good article here which discusses the legality of such things.

"Monday's news that the Obama administration is considering a military hit on an American terrorist raises anew the issue of what justifies such a step, according to both the law and the public conscience in an era of political, social and technological evolution.

"America's legitimate claim of self-defense cannot be the end of the discussion," President Barack Obama said last year when he announced new guidelines on drone strikes that target enemies for killing. "To say a military tactic is legal, or even effective, is not to say it is wise or moral in every instance. For the same human progress that gives us the technology to strike half a world away also demands the discipline to constrain that power -- or risk abusing it."

The American Civil Liberties Union contends the administration abuses its power, particularly when it comes to drone strikes that have targeted foreigners and in some cases, American citizens."

I'm guessing the guy is not a tourist.

I think when you take up arms against the U.S., and there is clear and definitive proof that you're a traitor, then it's bye-bye cold fanny as my dad used to say.
 
As an American citizen we're entitled to due process under the law. With some's concern over FEMA camps and the like, you'd think people'd have a problem with the government murdering its own citizens.

As an American citizen we are not entitled to go to a foreign land and join militants and attack our fellow countrymen.
At that point...you gave up your rights.
 
Legally, without a finding of fact you don't relinquish anything.

Same issue arises when foreign diplomats with diplomatic immunity commit serious crimes on US soil. Though you might think they forfeit such immunity commiting murder and the like, they don't. Still have to jump through legal hoops to have that immunity removed.
