That's what the DOJ got the Proud Boys and Oath Keepers on. Insurrection is under US Code 2383. To this point, who has been charged, much less indicted or convicted of violating the US Code for insurrection? Don't play word games or semantics. Actual names of people. At this point, two years later, why are there investigations? Unless the DOJ is THAT incompetent, that should've figured out if there was one and who were involved a while ago.

BTW, can you point to the testimony and/or their lawyers that has said or strongly hinted that the DOJ was investigating Rep. Jordan? Because if it's already out there, then the DOJ can't play the confirm or deny game. The people who said would've been testifying under oath.
