In another blow to House Speaker John Boehner, House leaders abruptly called off a vote on legislation to address the influx of unaccompanied undocumented children into the United States after failing to secure enough votes to pass it.

The vote had been scheduled for Thursday afternoon, just before members were scheduled to leave town for their summer recess. But conservative Republicans threatened to break with their own party to vote against the GOP-authored measure, arguing that the legislation doesn’t do enough to stem the flow of new migrants into the United States. Texas Sen. Ted Cruz, a Tea Party leader in the Senate, had actively been whipping up opposition to the bill in the House.

In a last-ditch effort to shore up support, House leaders have scheduled a meeting with members for 3pm ET Thursday afternoon to discuss a way forward.

Failure to vote on the bill would represent another black eye for GOP House leaders, who had seemed confident Thursday morning that they would be able to pass the bill and tout at least some action to address what all sides have called a humanitarian crisis.

House Republicans called off a vote on their $659 million emergency response to the border influx from Central America overwhelming immigration resources, unable to agree among themselves about what to do.

After first saying the bill was pulled, the GOP leaders called a caucus meeting for later Thursday and said more votes could take place.

House Republican leaders abruptly pulled their border supplemental legislation prior to a scheduled vote on Thursday, a sign that they lacked the votes to pass it. That means members would go home for recess without acting, a situation that GOP leaders wanted to avoid.

Immigration-weary conservatives said the $659 million supplemental, and the subsequent measure to end the Obama administration's Deferred Action for Childhood Arrivals program, didn't go far enough in rebuking the president's actions.

It was a remarkable defeat for the new GOP leadership team on the day that Rep. Eric Cantor (R-VA) stepped down as majority leader...

...House Minority Leader Nancy Pelosi (D-CA) was relieved by the GOP's decision to pull the bill.

"Oh my god. It was so awful," she told reporters. "Thank god."

Adam Jentleson, a spokesman for Senate Majority Leader Harry Reid, told TPM in an email that the Nevada Democrat is pleased to see GOP leaders acknowledge that Obama has executive authority to act on immigration.

"Senator Reid agrees with House Republican leaders’ statement that President Obama has the authority to take steps on immigration reform on his own," Jentleson said.

(Reuters) - House of Representatives Speaker John Boehner said on Thursday that any unilateral steps by President Barack Obama on immigration would make matters worse and add to a "legacy of lawlessness."

"No more unilateral action by the president," Boehner said at a news conference.

"If the president takes these actions, he'll be sealing the deal on his legacy of lawlessness," he said. "He'll be violating the solemn oath he made to the American people on the day of his inauguration."

It was pretty embarrassing to watch them flailing around, torn between telling more lies about Obama and their real agenda - another vacation. There's no doubt that Ted Cruz is in charge of the house and Boehner is in charge of smoking and drinking and playing golf.

The sooner they leave on vacation, the better.

Top 10 Problems with House Border Bill



The bill proposed by House Republicans (H.R. 5230), not only fails to address the root causes of the border surge or hold President Obama accountable, it actually weakens current law. While distracting from Obama’s DACA and promises of amnesty with statutory minutia over the 2008 anti-trafficking law, the House bill actually makes matters worse and voids out the entire purpose of modifying that law:

1) No Mention of DACA Amnesty: This is not only the cause of the border surge, it is an ongoing threat as Obama openly promises to grant amnesty for 5-6 million more people. The glaring omission and the fear to even mention it will not go unnoticed by Obama.

2) Only Addresses UACs: Republicans have completely bought into the messaging from the White House that this crisis is all about unaccompanied children. Yet, UACs only account for 20% of the recent surge in border crossings. This bill does nothing to address the catch and release policies of the other 80%.

3) Does Not End Catch and Release: Although the bill repeals Section 235(a) of the William Wilberforce Trafficking law and places UACs from non-contiguous countries into judicial proceedings, nowhere does it prevent HHS from releasing them into custody of relatives (often illegal immigrants) during the myriad of delays in proceedings subject to the discretion of the judge. So even though they are selling this bill as a means of expedited removal, as it requires adjudication within 7 days and a decision within 72 hours thereafter, that is only relevant to those who bother to attend or show up to subsequent hearings. Without ending catch and release, almost none of the UACs will ever appear before a court.

4) Does Not Close Asylum Loophole: Even those few who appear before the court and are ruled inadmissible to the U.S. can have a chance to apply for asylum with a claim of “credible fear.” [page 21] As we already know, there is an unlimited supply of pro bono immigration attorneys who will coach them to claim persecution. A whopping 92% of credible fear applicants have been approved in recent years. Once their claim is accepted, they will be sent back to HHS and likely released into custody of relatives. This bill actually insults our intelligence and addresses the asylum loophole in Section 106….only for drug smugglers! Everyone else is explicitly granted the opportunity to seek asylum.

5) Makes UAC Crisis Worse with De Facto Amnesty: Section 103 [page 27] of this bill mimics the provision in Senator Cornyn’s bill, which actually makes it easier for recent arrivals to thwart deportation than under current law. It allows all those who received a Notice to Appear since January 2013 to get a second bite at the apple. Their notice will be expunged and they will have another chance to apply for admission, even if they ignored previous orders to appear. The immigration judge will then have sole discretion to grant amnesty as long as “the granting of such motion would not be manifestly unjust.” [Section 103(c)(3)]

Tea Party out-muscles Boehner on border-security funding


(Reuters) - A bill to fund border security blew up in House Speaker John Boehner's face on Thursday, leaving Republicans in disarray and struggling to reconcile Tea Party demands with the need to deal with a humanitarian crisis on the southwestern border with Mexico.

Boehner, the top U.S. Republican, withdrew the bill after failing to corral a sufficient number of Republican votes for passage. That left him in an all-too-familiar position of having to somehow pass legislation or risk damage to his party in the November congressional elections in which Republicans are trying to capture the Senate.
