If a prosecutor alleges as part of an indictment (as Smith has) that a defendant “lied,” then any evidence which bears upon that issue (belief in what the accused said) becomes critically material and absolutely relevant. Any judge who tries to prevent it’s introduction into evidence at such a trial is swiftly going to see any conviction reversed on appeal.
