Federal Judge Dismisses Case Trying to Keep Trump Off 2024 Ballot

Trump isn't charged with paying hush money to Stormy, he's being charged with falsification of New York business records. The FEC has no bearing on business records and no the SCOTUS has not said business can ignore state business laws and can spend money how they wish and not properly account for it on their books.

He didn't try to "verify election results" he attempted to strong arm the Governor to find 11,780 (a very specific number, being 1 more than he needed to win) and then implied (using mob language) that if Gov. Kemp didn't find them he could be prosecuted.

I agree, I think this is the weakest case.

Ummm - "Ex Presidents" have 0, zero, nada, zilch rights to declassify documents.
I agree though, Trump will never see prison. Maybe home confinement for security reasons.

WW
1. True, the charge was falsification of business records.......relating to the hush money to Stormy. The FEC and USSC has said no crime for using your own money, here's Turley's man'splain:

Bragg released an indictment that was so vague on key elements that it is unclear what the grand jury thought it was voting on. He vaguely referenced state and federal election laws and later refused to add any details on how they relate to the prosecution. The result is an indictment with the substance of a legal Slurpee: it was immediately satisfying for many with virtually no legal substance.

2. "Attempting" to strongarm "to verify" election results. We'll see how this plays out. Fani is in way over her head. I hope she needs to have 18 trials with several in Federal Court, Trump's last after all the evidence is known, in a Federal Court with a real jury.

4. Agreed ex-presidents can't declassify. Trump will claim that he declassified them as president before he left the WH. Pence had docs, Biden had docs, Hillary had docs and destroyed them, Sandy Berger stole docs and got caught, no one served any prison time. AG Barr said Trump violated the law, so we'll see how this plays out on appeal. Not sure if Berger got hit with a felony?
Berger lost his Law License, paid a $50,000 fine and did community service.

Actually a brief summary of the 91 indictments is:
1. The Bragg case in NYC for paying hush money to Stormy will be dismissed. The FEC and USSC already said that Trump can do whatever he wants to do with his own money. Cohen didn't use his own money.
2. The Fani RICO case in GA will be defeated because Trump is allowed to verify election results
3. Smith's J6 case will be dismissed because of "free speech"
4. Smith's classified docs case may or may not result in a conviction, depending upon the rights an ex-president has to declassify docs. Even if convicted, Trump should not get prison time based on the Sandy Berger precedent, where he stole classified docs, got caught, and then just lost his security clearance.
Actually a brief summary of the 91 indictments is:
This is some bizarre fantasy land that you’re living in Pal. You must be having night sweats over the impending demise of you lord and master. Your so call summary is nothing but a carload of codswallop
1. The Bragg case in NYC for paying hush money to Stormy will be dismissed. The FEC and USSC already said that Trump can do whatever he wants to do with his own money. Cohen didn't use his own money.

The issue is not whose money it is but the fact that he concealed the payment to Daniels by falsifying business records and laundering it through Michael Cohen. Furthermore, it was bumped up to a felony because that crime was committed in the furtherance of another crime- campaign finance violations
2. The Fani RICO case in GA will be defeated because Trump is allowed to verify election results
You can’t be serious with that tripe. There is so much more to it than verifying election results. There is the matter of the fraudulent slates of electors for one thing. And then there is the “perfect phone call “ asking to finnd 11,780 votes “just one more than what we have” And that is only the beginning
3. Smith's J6 case will be dismissed because of "free speech"

More Jabberwocky . The case is not about free speech. Smith was careful not to make it a first Amendment issue by not charging him with inciting the riot. The charges all stem from his actions aimed at trying to overturn the election
4. Smith's classified docs case may or may not result in a conviction, depending upon the rights an ex-president has to declassify docs. Even if convicted, Trump should not get prison time based on the Sandy Berger precedent, where he stole classified docs, got caught, and then just lost his security clearance.

May or may not result in a conviction.?? This may be the strongest case of all. He was caught red handed with physical evidence in the form of video and audio recordings and the documents themselves. He endangered national security. There is nothing more worthy of jail time

You might recall that Trump himself signed legislation making such an offence a felony punishable by jail time in the hope that he could use it to get Hillary Clinton. There si a real knee slapper for you. In addition: Ex-Defense employee who mishandled classified materials gets jail time | CNN Politics There have been others too;

Sleep well !!

Tldr.

If you agree that in NY President Trump is being charged with something that is not actually a crime.
Then, Si'.

I'm not living in Fantasyland. The hick DAs who are indicting Trump are the ones living in the Twilight Zone

1. GW Law Professor Turley says that Bragg's 31 indictments are flawed. Anything related to a violation of Federal Election Laws will get tossed. There was no violation of Federal Election Laws, the FEC dropped the Stormy investigation, Trump can do whatever he wants with his own money

Bragg released an indictment that was so vague on key elements that it is unclear what the grand jury thought it was voting on. The result is an indictment with the substance of a legal Slurpee: it was immediately satisfying for many with virtually no legal substance.

2. Asking for recounts and preparing for a potential overturn is not illegal. Fani is in way over her head, and it shows.

3. Google "Sandy Berger steals classified docs". He paid a $50,000 fine and got 100-days of community service. Trump has the PRA (Presidential Records Act) to battle with. AG Barr thinks Smith has a good case, we'll see.

I can cherry pick legal opinions too.

The fact is that your guy is a Libertarian. They don't even believe in the law and should not be lawyers

More horseshit. The recounts were done many times. The court cases concluded. The election was certified by the state when he call the SOS to twist his are over finding votes . The electors were already selected for the winning candidate when he tried to substitute phony electors. You really seem to be struggling

Now you are just being pathetic. The Berger case was in 2005 BEFORE your stupid ass Trump signed the law making it a felony. Since that time others have gone to jail for less agregious acts involving classified documents. And Trump is not protected by the Presidential Records Act. He is charges under the Espiange Act

I can cherry pick legal opinions too.
The fact is that your guy is a Libertarian. They don't even believe in the law and should not be lawyers
Meh. Pushing the Trial back till after the election makes it irrelevent. Bragg has the weakest case anyway.
My "guy" is a fucking Law Professor dumbass. Your comment makes no sense.

Thats why we have trials, and in Fani's case, several trials, we'll just have to wait and see how they all turn out.

My comment makes more sense than anything that you said. Libertarians do not belive in accountability. They think that everyone should be able to do whatever the hell they want, whenever they want, to whoever they want.

Trump's defense will be the PRA and Clinton's sock drawer tapes. Judicial Watch was told if the ex-president takes it out of the WH its his personal property. We'll see how this one shakes out in court. AG Barr thinks Smith has Trump by the short and curlies. I hope so, prefer Desantis or Nikki.

You said:
"The fact is that your guy is a Libertarian. They don't even believe in the law and should not be lawyers"

That is plain stupid when describing a LAW PROFESSOR.

Trump's defense will be the PRA ...

And that will fail for two reasons:

#1 The PRA very clearly defines the difference between Presidential Records and Personal Records and that 100% Presidential Records are the property of the United States government.

#2 The PRA has nothing to do with classified documents which are NEVER personal property.

and Clinton's sock drawer tapes. Judicial Watch was told if the ex-president takes it out of the WH its his personal property.

No they weren't. Judical Watch sued the NARA to force them (basically a writ of mandamus) to get the tapes from Clinton. The ruling was they had not power to be forced to retrieve personal records, which the tapes were classified as as Taylor Branch was functioning as a personal historian, and the PRA clearly exempts personal diary type of records.

We'll see how this one shakes out in court. AG Barr thinks Smith has Trump by the short and curlies. I hope so, prefer Desantis or Nikki.

Ya, DeSantis is a used car salesman trying to sell himself as more Trumpy than Trump - I don't buy his schtick. I can go for Haley as a return to more old school type sane Republican's instead of the current whack-a-doodle crop that dominates the news (Trump, MTG, Geatz, etc.).

And we shall find out . Be prepared. She is a pit bull and very smart as is Jack Smith. The fact that you are in deep denial and cant face the facts is not my problem and I can't help. I am not a psychotherapist. Speaking of fact, try to get your head around this FACT. People who sit on Grand Juries are not idiots and they are not robots who were programed by the prosecutor. They only indict if there is evidence of a crime. In this case 91 crimes

Federal Judge Dismisses Case Trying to Keep Trump Off 2024 Ballot

1 Sep 2023 ~~ By Cristina Laila

A federal judge on Friday dismissed a lawsuit filed by a Florida lawyer who claimed Trump should be banned from the 2024 ballot for inciting an insurrection.
The legal theory is based on Section 3 of the US Constitution’s 14th Amendment which states public officials who have “engaged in insurrection or rebellion against” the US may be disqualified from public office.
Trump has not been charged with engaging in insurrection or rebellion against the United States.
Judge Robin Rosenberg a US District Judge for the Southern District of Florida ruled the attorney, Lawrence Caplan, lacked standing to bring the lawsuit.

Commentary:
This decision sets the precedent to dismiss any and all attempts to keep Trump off the ballot based on the 14th Amendment. It's a huge loss to Democrats is Florida. Debbie Wasserman was seen in tears vowing revenge against the Obama appointed judge.
:abgg2q.jpg:
But, have no fear Maoist Democrats will shop around in Blue controlled states to find a Soros funded Marxist Judge to agree with them.
The 5th Amendment is where it's at. Trump was tried in congress twice and found not guilty. Now the Maoist Democrats are seeking another bite of the apple, double jeopardy, all the cases involving Trump and January 6th should be tossed.

First off, REPUBLICANS are filing these suits, not Democrats. Democrats aren't trying to keep your asshole candidate off the ballot. It's REPUBLICANS who are trying to keep Trump off the ballot. Do try to keep up. The lawyer who filed this suit is an independent.

This decision sets no precedents whatsoever. The person filing the suit has no standing, so unless you think that having a suit dismissed when the applicant has no standing is new or unique, you clearly haven't the first clue about what you're saying.

Debbie Wasserman Schultz has NOTHING to do with this.

1. Vague???? What part of it was vague. The crime was falsifying business records by trying to claim the bribe to his mistress, as a businness expense. Nothing to do with the election, FEC or anything other than trying to claim a personal expense - buying silence from a mistress, as a tax deductible business expense.

This is tax evasion, pure and simple. He falsified business records so as to falsely claim the bribe as a tax deduction.

Please don't quote that hack Turley to us. That guy will write you any opinion you want if you pay him. He testified at Bill Clinton's impeachment that it was necessary to impeach Clinton for such a minor offense having nothing to with his office or his actions as President, because otherwise, Presidents will think they can get away with stuff. Morality matters.

At Don Trump's impeachment trial, Turley told us that Trump should not be impeached for anything so minor as bribery and extortion because it lowers the bar on impeachment so that any President is vulnerable to impeachment.

The guy is for sale and is opinion has no merits whatsoever.

Lets hope Biden and Trump both get dumped and we can get back to a new normal.

Desantis is governor of FL, and a Vet. He's probably too much of an introvert to get the nomination, but he's more than competent.

John Eastman was also a law professor. A law school dean no less. Look at him now
