University of California cop who pepper-sprayed student protesters awarded $38,000 - U.S. News

A former University of California policeman who stirred public outrage by pepper-spraying peaceful student protesters has been awarded $38,000 in worker's compensation for psychiatric damage he claimed to have suffered from the 2011 incident, the university said on Wednesday.

A scathing 190-page report on the incident found that university officials and UC Davis police used poor judgment and excessive force in the confrontation

The university last fall agreed to pay $1 million to settle a lawsuit brought on behalf of the 21 students who got sprayed and later reported suffering panic attacks, trauma and academic problems as a result.

In June of this year, Pike himself filed a worker's compensation claim with UC Davis over the incident, saying he suffered unspecified psychiatric and nervous system damage, though the document did not explain how he claimed to have been harmed, records show.

On October 16, the state Division of Workers Compensation Appeals Board agreed to resolve his claim by paying him a settlement totaling $38,055, UC Davis spokesman Andy Fell said on Wednesday.

this is ridiculous. the students got 1 million for 21 of them and this one got 38K for spraying them

TORT reform ASAP.

Good for him. People can protest and local municipalities can make restrictions on demonstrations. The OWS scum throughout the country were useless bags of excrement focusing their ire in the wrong direction, because in reality they are progressive filth who want the government to confiscate the wealth of others. If they were in charge, they would have had that cop round up businessmen and bankers, torture them and throw them in prison.

Poor little punk ass bitches. I hope every one of them goes blind someday from the pepper spray.

They weren't peaceful protesters. They had surrounded the man and were threatening.

It's unfortunate that this man had his life ruined for doing his job.

This is one of those things that looks real bad on TV, when it's taken out of the bigger context. He followed procedure. Cops dealing with illegal protests and trespassers are put in a difficult situation as the protestors are usually kids caught up in the moment--and pepper spray and tasers seem over the top and horrible, but compared to fire hoses, german shepherds and batons, they're actually very "progressive" methods to deal with public disorder.

You have to consider the consequences of doing nothing when protestors without permits or permission refuse to disperse -- what would happen if we just let them get their way and stay as long as they want? They would continue to push the envelope, seeing what they can get away with.

$38K is nothing compared to the pay off the students got.

Bottom line, Occupy Wall Street failed to bring about meaningful change... whereas The Tea Party has been very successful in blocking meaningful change.

Maybe Occupy Wall street needs their Glenn Beck.

Workmans comp? Why exactly does someone deserve workman's comp for pepper spraying people. Doesn't matter if the pepper spraying was deserved or not, that's just absolutely ridiculous. There has to be more facts to justify that.
