The smoking gun was on the e-mails that Mrs Clinton first "deleted" and then hired professionals to clean out of her private server which she used in violation of Federal Laws and Rules.

But, you don't have to have proof beyond a reasonable doubt to indict...or more importantly to NOT vote for her, you just need the very circumstantial evidence which is now flowing forth in torrents from the New York Times, Washington Post, and others. The repeated patterns of highly suspicious conduct is damning.
