On his cab firm’s website, Dahbi announced that he would pursue an appeal of the ruling, and that “there was no real injury here.”

That was after last years court fine of $10k.

This latest fine was from the "NYC Commission on Human Rights" who seem to agree with the Judge from the initial case.

Of course they have the disadvantage, unlike yourself, of actually hearing all the evidence.

They should make his license conditional on his response to diversity training as he is not suited to deal with the public.

Actually cab drivers should be able to ask people to not make out in their cabs without being abused and without racist attacks.
The cab driver is a captive audience - he can't just walk away.
And anyway, 'civilised people' - with whom you have no common currency whatsoever - don't force captive audiences to witness their foreplay.
Can't they just wait for somewhere private? to get home? Why be exhibitionist about it? Why infringe on other people's right not to be subjected to public displays of intimacy?

One contains actual harm, the other "hurt feelings".
