First everyone should agree with these experts, i.e. physicians that send the claims to insurance companies and Medicare.
Anyone with any common sense should recognize that if these physicians are telling us they are requesting duplicate tests, referring to
specialists ALL BECAUSE they are afraid of lawsuits that should be believed. These physicians said and I'm not making this up:
..doctors all contend they spend 34% of the national $2.5 trillion in duplicate tests, referrals to specialists, etc.
ALL out of fear of lawsuits! That's $850 billion .. a YEAR!
Findings from this survey include the following:
  • Physicians estimate the cost of defensive medicine in US at $650 to $850 billion per year. This is 26 to 34% of all US healthcare costs.
  • Up to 92% of US physicians practice defensive medicine.
  • 76% of physicians report that defensive medicine decreases patient access to healthcare.
  • 53% of physicians report delaying new techniques, procedures, and treatments due to fear of lawsuits.
  • Patients most affected by defensive medicine include those visiting emergency rooms and those requiring surgery.
  • Women are most affected by defensive medicine.
  • Emergency medicine, primary care, and OB/GYN physicians are most likely to practice defensive medicine.
  • 79 to 83% of surgeons and OB/GYNs have been named in lawsuits.

So when Obamacare taxed tanning salons for causing cancer, it should be common sense then to tax lawyers for causing the $850 billion a year in defensive medicine.
10% of the $200 billion lawyers make generates $20 billion.

Now when the fact there are less then 4 million people that truly want, NEED and are eligible for insurance should be they can be covered by the $20 billion tax!

Further when these uninsured go to hospitals for care they are registered with and the claims sent to the Uninsured Health Insurance Co©.
As a result the hospitals will be audited to make sure claims submitted to Medicare/insurance companies are marked up as some Medicares have been 6,000%!!!

With the tax declining as the $850 billion declines and with the hospitals no longer marking up @ 6,000% the $850 billion PLUS wasted claims will be reduced!
I project easily $200 to $400 billion a year in cost reductions due to reduce defensive medicine/hospitals padding and passing!

As a result ALL Americans that are eligible that want insurance are covered! Problem solved without destroying the rest of the 98% of us health care!

not a bad plan. tax the frickin lawyers.....

I don't expect any congress or Obama to go for it since in 2008 lawyers donated $300 million to Dems/Obama!

But when the get around to scrapping Obamacare this would definitely costs the REST of us nothing and coverage would be available at hospitals for the "uninsured" to be registered (after appropriate MEANS testing!!!) as a policy holder. Then all claims would be submitted
to Uninsured Health Insurance Co.© and hospitals under AUDIT supervision prevented from padding and passing on to Medicare!
As a result Medicare costs decrease as well as the defensive medicine costs!

WASTED wasted money... and I KNOW how much waste there is in these hospitals/Medicare transactions.
If you'd like to know what your largest hospital in your city overcharges Medicare tell me the name of your city or make up a city I don't care but it will amaze you how much "Vigorish" is added to the claims!

Kind of funny you bring up this point guess I was being brainwashed into thinking E.R. vists by regular folks and illegals was the main culprit. I forgot about this.... thanks.

there was no healthcare crisis in the USA. No one was being denied treatment--even illegals were getting free medical care.

Obamacare created a problem where there was none.

South Carolina hospitals sends the bill to the S.C. I.R.S. just saying....and they will garnish wages off that hospital bill as part of their collections.

So you think you should get free healthcare when you have a job and can afford to pay the bills?

Nope but you said it was free and not everywhere. I guess.

"healthmyths",

I'm curious. Is your purpose here to dispel myths about health care, or propagate them?

Actually the REASON Medicare is OK with hospitals overcharging sometimes 6,000% above costs is directly linked to EMTALA a classic example of
The "law of unintended consequences" "intervention in a complex system invariably creates unanticipated and often undesirable outcomes."
Unintended consequences - Wikipedia, the free encyclopedia

In 1986, Congress enacted the Emergency Medical Treatment & Labor Act (EMTALA) that if a hospital takes
Medicare, they have to regardless of an individual's ability to pay. provide stabilizing treatment for patients.."
From that point forward hospitals had to recover so they overcharge Medicare and Medicare is ok with that!
If you have a hospital you'd like to know how much they overcharge Medicare for outpatients give me the name and I'll show you what I find out!

I don't dispel myths. The facts do! All I ask is check out the links I provide as I don't make this stuff UP!

Defensive medicine is very profitable for the healthcare industry. Does anyone think the industry really wants it to go away?

"WHAT HEALTHCARE INDUSTRY" are you talking about?

Why would these professionals want to upset the "profitable " defensive medicine" ???

I mean these guys are making "profits" off this so why would they want to reduce it??

Bai:
"Defensive medicine, at least in my opinion, occurs when the fear of litigation is the major motivating factor, and probably the only factor in the physician ordering that test.
Thus, a defensively ordered test has no benefit for the patient whatsoever. If there is any benefit to the patient, even reassurance, then the test, at least by the definition proposed here, is not part of defensive medicine.

"It is important to explore the viability of an administrative system similar to the Workers' Compensation system," said James Madison Institute Policy Director Robert F. Sanchez in a press release. "At present, the practice of defensive medicine inflates the cost of health care to cover the inflated cost of malpractice insurance. This needs to change."

I can read, you don't have to repeat yourself.
Now think, who reaped the profits? $650-850 billion is a lot of money and a lot of profit is built into those numbers. I thought you were a healthcare expert?
Healthcare in a business and in America, it's a huge profit making business, otherwise the cost of healthcare in the US would be competitive to the rest of the world.
So "industry" would be about every entity associated with the healthcare business.

[that dont look right spl?] I still say its another game of trickle up poor. with obama care forgot to add that

The crisis was our Pub health "system" costs twice as much as anywhere else with worse results, ruins our competitiveness, and is STUPID.

Everyone needs health care and not ridiculously expensive ER/bankruptcy care.. Sorry about your Bush giveaway Medicare Advantage, greedy tool of the idiot rich swine... And Pubs want to cut that too.
