Almost immediately after Justice Anthony Kennedy announced his retirement on Wednesday, Senate Democrats argued that his replacement should not be confirmed until after the midterm elections this fall — a version of the same argument that Mitch McConnell, the Senate majority leader, used to stymie President Barack Obama’s nomination of Merrick Garland to the Supreme Court in 2016.

This is surely a valid argument, not least because Mr. McConnell’s blatantly anti-democratic ploy stole a judicial appointment from a popularly elected president and gave it to one who lost the popular vote by millions.

But there is another reason to withhold confirmation that both Republicans and Democrats should be able to agree on: People under the cloud of investigation do not get to pick the judges who may preside over their cases. By this logic, President Trump should not be permitted to appoint a new Supreme Court justice until after the special counsel investigation is over, and we know for sure whether there is evidence of wrongdoing.

True, that point is unlikely to stop Mr. McConnell or his colleagues. But it highlights the real risk involved in letting a deeply compromised president shape a court that may one day stand between him and impeachment.

Midterms are not the same as Presidential election years President Obama nominated Elena Kagan on May 10th 2010 a midterm election year Kagan's nomination was confirmed by a 63–37 vote of the United States Senate on August 5, 2010. If there is an open seat on the court in 2020 the left has a valid point about waiting till after the election to fill it not the case here.

First of all, "a version of the same argument" is just another way of saying, "It's different, but we WISH it was the same". So bullshit to that.

Second of all, in what way are we supposing that this particular SC nominee would "preside over his case", even supposing you leftists could gin up an actual investigation, rather than a cloud of accusations with no apparent evidence? Last time I checked, the only member of the Supreme Court involved in aPresidential impeachment is the Chief Justice. If Trump is tried on some sort of criminal charge - which is an even bigger stretch than impeachment - he will be tried by the court with the appropriate jurisdiction, depending on the charges. Whichever court that might be, it would not be the Supreme Court.

Third, the notion that the President loses his power to nominate judges because of a vague possibility that he MIGHT be charged with something at some nebulous point in the future is asinine. By that standard, no President would ever be allowed to appoint ANY judge at all. There is a reason why the courts have the concept of recusal.

He's appointing a Justice. You can't stop him. This is the consequence of losing an election. Next time, choose a candidate who isn't viscerally repulsive. Now stop blubbering and butch up.

Delaying the appointment of Supreme Court justices is absurd.

The only reason why there was a vacancy on the court in 2016, is because Scalia got whacked to stop the Friedrich decision which would have defunded Big Labor and the La Cosa Nostra. To allow B. Hussein O to appoint an extremist lib like Garland to replace a rock solid pillar of justice like Scalia would have been a miscarriage of justice as well as having altered the delicate balance on the court.

Kennedy is another Republican seat. Get fresh blood in there, Kennedy is an octogenarian. Reversing Gay Marriage is now a possibility- rolling back Obama Era Extremism is what the Trump Administration's goal is.
