This is truly momentous: the issue is vital to the power of what has become known as the administrative state. The “independent” agencies, supposedly staffed by experts, are largely unaccountable and have become a fourth branch of government that is nowhere contemplated in the Constitution. Under Article II, “The executive Power shall be vested in a President of the United States of America.” Period.
