You're right. Let's take the " what ifs" out of it and take it to it's core. Neely was threatening to kill people, acting erratically, Penny tried to subdue him before he could do anything, but his choke hold went wrong and he accidentally killed the man. If you can prove he intentionally killed Neely, then I will agree with you, but until that point, all you have is a guy who was trying to protect himself and the passengers of that subway car.
Save that bullshit about he accidentally murdered him. All I see is a man who murdered and unarmed man who hadn't done anything to anyone.

A black man DID murder someone - stabbed him to death - on a subway a month later, and they let him off. He even tried to evade police, while Penny remained on scene, but they let him off for that as well.

This is what happens in liberal cities and states - go easy on the black man, and throw the book at whitey.

Yes. He was making some very serious threats. I believe he was saying how he was "ready to go to jail" and such.

But, I don't understand why Penny kept him in a chokehold for so long, long after his body had gone limp. Also, I believe the victim was quite small in frame. I kind of think Penny might have used excessive force.

I didn't say I could read his mind. I went by what he said. I don't know for sure if he was being 100% truthful, but I don't have any real reason to doubt him.
