Why Do We Focus on Innocence, not Guilt?

I’ve wondered about this for years because it’s the exact opposite of how I would set up a Justice System…

Why the hell does our Legal System focus so much on making sure the innocent go free rather than making sure that the Guilty get appropriately punished for what they’ve done wrong?

It just seems so completely backwards to me. Especially in a society where so few people are truly innocent

I'm not sure if you are aware but you separated from the monarchy 250 years ago.

A man is considered innocent because if not you'd have the same type of creepy system that the old Soviet Union, some pockets in Canada or China employ "you are guilty because the covert Creepy Ones say you are".

As one famous Russian dirtbag said "show me the man and I will show you the crime".

Perhaps there are a few too many in the West who need to be reminded about such basic principles.

It works when the prosecutors fight to convict and the judges are impartial.

Now we have prosecutors that see the criminals as victims of "the system" and judges that favor the criminals for the same reason.

That Russian was correct. If we could truly read the hearts and minds of the 320 million Americans, few would not be shown unworthy of spending the rest of our lives in prison for one thing or another.

I would rather see ten “innocents” in jail than to see one Guilty person go free.

By your standards, you'd probably have 120M in jail today, perhaps more.

Even if you were one of the innocents sitting in a prison cell, getting raped in a nightly basis?

The exact quote is that is better for 1,000 guilty to go free rather than have one innocent convicted. Personally I think that ratio is too high. I'd put the number closer to 50 or 100. Yes it would sick to be the one, but it would suck worse for everyone to have 50 or 100 violent criminals preying on society.

But that's just me. We should as a society decide what level of imperfectness in our criminal justice system we are willing to live with and tailor it for that.

And proudly so. Criminals are sub-human scum. They need to be punished quickly and harshly for the benefit of society as a whole.

We don't enforce laws against hearts and minds, only actions. Otherwise 100% would be in prison and there would literally be no one to serve as guards.
