The matter of back pay is left to Congress in accordance to the amendment in the cited law. No doubt the Executive's input will play a significant role.

I never understood the reason for government shutdowns if you are just going to pay nonworking employees back pay anyway. What’s the point?
 
When there is a shut down 100% of workers should be sent home. None of this essential workers bull shit.

No work, no back pay.

Shut down the airports, rails, and ports.

No Ss checks, no military retirement checks, no SNAP, no processing government financials, the list goes on.

If we had real shutdowns, there would be no shutdowns.

They don't get paid back pay for days they didn't work.

The government workers use the same mechanisms available to everyone else. They aren't special.

I cannot fully agree that it is through no fault of their own. Most federal workers vote Democrat, so they voted in the very people who are now openly admitting that they are causing this suffering in order to have "leverage."

That would be even more true of furloughed workers, i.e. non-essential workers. A person who does not understand how important it is to make oneself essential at their job is sure to be a Demoratic voter.

I would not call it an "aggressive interpretation," but rather a "taxpayer-friendly interpretation."

Then it is not a hard and fast rule. It is discretionary by the appropriators.

If I had the decision, I would give the furloughed non-essential workers these options:

a) Get full "backpay," plus two weeks severance, then buh-bye.
b) No backpay, come back to work and then you have 90 days to make yourself essential (which would start by coming to work instead of "telecommuting.") If you cannot find any essential work of which you are capable, then take the severance package.

My theory is that Trump is giving Johnson and Thune a bone to throw to Schumer and Jeffries. "Sign the clean CR and we will give your lazy-assed voters their "backpay."
