Section 3 of the 14th Amendment states that no former government officials can hold office, neither civil nor military, in the U.S. if they “have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.” add in the fact if found guilty he could be sent to prison on other charges and would have to run his office out of prison. Not as simple as just yes he can.

While it's true the Constitution does state that, Trump is not facing any charges regarding insurrection or rebellion. And the the J6 committee did refer such charges to the Department of Justice, the DoJ has not moved to indict Trump on any such charges.
