Well Sheite, I would hope that the prospect of possibly loosing your child might weigh heavily on a parent prior to overtly flaunting the sovereignty of a foreign nations borders and known laws! That is not the same as leveraging a criminal already incarcerated with dangling their children's well being as a carrot from a stick. There is absolutely NO ambiguity in the ramifications of entering this country illegally and the protocols that have been in place for decades in processing those who come here alone or with minor dependents. Hopefully new legislation will continue to make the ramifications and deportations more severe and immediate!

So, if you just watched the video, 10,000 of the 12,000 currently under state care, the parents sent them alone across the boarder.
There are no parents to release them to, even if the judge were to allow electronic confinement. The Feds didn't separate kids from parents, the parents separated themselves from their kids.

That's why as all right-wingers here have said, it's fair more caring to close the boarder and prevent human trafficking like this.

So again, what would you do with them?

Second, even for those parents with children, there is no legal way to use electronic confinement to a private property... when you have no legal residence. Are you going to setup a motel with electronic confinement? You think a motel would want that? "Yeah here's your key to room 103 by the electronically confined illegal."

In fact, legally, that isn't even possible. The state or local government has jurisdiction to do that. The Federal Government, can't dictate to a state or local government, that they have to setup and support electronic confinement programs. It doesn't work that way.

The Feds are not going to release violators to Federal Law, to state governments, just so they can have electronic confinement. And the Feds don't have the ability to run such a program.

Not to mention that this could be a massive problem if the Feds released someone who isn't even supposed to be in the country, on electronic confinement, and they run off and commit a crime, this could be a nightmare PR disaster for the Feds. That isn't happening.

And the potential for people running off would be extremely high. Remember electronic confinement doesn't stop anyone from doing anything. It just alerts the authorities that the person has left or taken off their collar. If you are an illegal, and do not want deported, and you don't think you have a chance at approval.... running off is your best shot. Since you have no residence, or legal ID, it's not like they have anything to track you on.
