The courts often fight with each other. Cases are sent back and forth from higher to lower courts and vice versa. What the courts need to do is to send bad laws back the legislatures for revisions that will make them work.

If a law is drafted and conflicts with existing laws....its sent back to legislators to revise.
Judges are there to interpret the Laws written and administer the Law. The ONLY creative use of their office that once existed was in delivering severity of sentencing, fines, and etc. However legislation gave minimum and maximum sentencing guidelines to judges after the creativity was abused by Liberal Judges. (Extremely light sentences for guilty verdicts on heinous crimes) As a result, judges became more activist.


Activist Judges write laws on the bench. (Absolutely wrong) but occasionally necessary when legislatures fail to act despite several pleas (Brian A. settlement) Then there's cases where regulations essentially draft laws that they never had authority to draft. Such as when the BATF made silencers almost illegal or magazine size limited or stylistic choices for firearms regulated.

Then,
we have liberals....and even though a degree in Law is not a requirement for certain judicial appointments it's a good idea. So the Liberals tend to appoint judges who are truly unqualified to sit on the bench. KBJ on SCOTUS is a prime example....

The Senate usually just rubber stamps Govenor and Presidential nominees....sometimes not.
But sometimes some get through.

Then theres the Prosecutors or District Attorneys....an odd mix of elections and appointments. Prosecutors/DAs can by abuse of office create defacto laws by which cases they choose to prosecute or FAIL to prosecute. Which when later prosecuted by someone noticing the problems created by failing to prosecute becomes a debate. (Birthright citizenship by illegal aliens)

The whole 'justice' system is a mess.

This is why conservative judges are necessary....not a choice.

Because if words dont mean anything anymore...then the consistency that has helped generate the oldest existing government in the History of mankind will fail. Anything and everything is legal depending upon the judicial mood. (Liberal judges in a nutshell)

most governments and cultures have disappeared....Jewish culture is the oldest. (Their government is new)

When the government fails....people die. Usually the frail go first and horribly. But people are selfish, greedy, and insensitive slobs. So they dont stop even when they see and know they are hurting others.

Will we survive the liberal judges appointed ? MAYBE.....only maybe.

Well that's not true...
They want to dispense what they think is justice instead of what WE, THE MAJORITY believe to be justice.

That's been the problem this whole time.

When the DA brings forward a 9 year old little girl for selling lemonade in her home driveway for tax evasion, no health inspection, and not applying for a business license...
The judge decides the case based on the laws and sentences her to be guilty and applies all applicable fines totalling into the thousands of dollars.

And the judge is considered a conservative for doing so.

The Judge scowls at the DA....throws the entire case out of court and fines the DA personally for even considering to take up the court's precious time with crap such as this.
That Judge is considered a Liberal.

The judge scowls at the DA. Finds the little girl guilty on all counts but vacates the conviction, fines, and throws everyone out of court before he gets really mad. And warns the DA he most definitely will be angry if he brings another case like this before him ever again.

That judge is a conservative with a brain.
 
Judges are either liberal or conservative and interpret the constitution differently.

What is wrong is that the courts are proving our laws are bullshit. If the laws were clear, simple and defined, then all courts, judges and attorneys would come to the same conclusions. All these courts and disagreements prove is that half of the judges are partisan, and the other half cannot even decide what the law is or really means.

If the law were legit, then you wouldn't need a lawyer much less a GOOD lawyer. All lawyers would come to the same conclusion: the LAW. You would not need a good, clever, expensive lawyer to get you off--- the LAW would free you.

Two areas where I fully support AI is in courtrooms and hospitals. Just imagine if every legal and medical decision were actually made by a super-brain which objectively reviewed all legal and medical findings and came to honest conclusions?

Here is for putting all of the lawyers, judges and health insurance companies out of work.
 
Judges are influenced by too many factors.

Newt Gig4theRich just wants Rightist judges, like the ones who struck down the New Deal. The Constitution, which was written by politicians for politicians, cannot paper over the partisan hypocrisy.
If you have read ALL that I've personally said about the judicial branch you would see a fairly balanced Approach with a few caveats.

The "Brian A. Settlement" being one of them.
The judiciary created this....not the legislature. And it was necessary for the children. They whined constantly about "unfunded federal mandates" which was code speak for all the grift the legislators weren't going to get out of the situation. And that was the holdup the whole time.

Courts answer to a judiciary committe in congress and the senate. Likewise those committees speak to the legislatures about issues stemming from pending legislation or of legislation that is needed.

Now the courts in creating the Brian A settlement are considered "activist" but that "Settlement " had been needed for DECADES by the time the courts took action. And something always was more important than getting it done.according to congress....(I and the courts call BS....but whatever)

The sentencing guidelines are a poke back at the courts by legislatures....especially when overly lenient judges let obviously guilty criminals walk free. Dunno why they would do such a thing....but I'm a normal person.
