Have you seen the large number of videos where the cops pull over a driver and the driver just "happens" to not have his/her driver's license on their person? When driving a car you are "required" by "law" to have your driver's license on you, with you, or provide it within 24 hours. That is the law in every state. For those that don't drive, they are supposed to have a "state" ID. Nothing Fascist about it.
Any law enforcement personnel that pull you over or stop you, to question you is in fact, "detaining" you. Albeit temporarily.
If you have nothing to hide, you simply show them your license or passport or whatever form of ID you have and you are free to go. Every time I've been pulled over, I immediately have my driver's license and registration held outside the car window and let them take what action they need to. I don't lie and claim I wasn't speeding or making a wrong turn. If you have nothing to hide, you don't have to worry.
Oh, if you travel to Europe and they stop you for something, you have to provide YOUR RS! If you travel to Asia and they stop you, they will ask for YOUR PAPERS!
Everywhere you travel to in the world, if the authorities stop you, they ASK FOR YOUR PAPERS!
I'm sorry LD, but you're incorrect in your premise here. "If you have nothing to hide" is bordering on fascism. I mean if you have nothing to hide, why not let police search your house? Rifle through your wifes panty drawer at will? I mean, she has nothing to hide, right? Pull you over for absolutely no reason and tear your car apart searching it, after all, you have nothing to hide in your car, do you?
Requirements are vastly different whether or not you're operating a motor vehicle upon our nations public roadways. In fact, as a commercial truck driver, I have to submit to any inspection by a duly sworn DOT officer at any time, anywhere, for any reason or none at all. Unfortunately, the law allows this for the "betterment of road safety" or some kinda bullshit. However, inspecting the truck is where it stops. They CANNOT search my personal items INSIDE the truck without a warrant, as the vehicle is an extension of the home. (remember that law?)
If you don't drive, you're not required to carry an ID with you. You're not even required to HAVE one. In every state in the nation, you cannot be stopped JUST to identify yourself. In fact, in some states, you aren't even required to identify yourself even if the cop has PC. But law enforcement cannot just walk up to you on the sidewalk and say "Prove your a legal resident." They have to have RAS that you're not. And then if they detain you, your constitutional rights kick in. They also cannot come into your house and arrest or detain you without a warrant. Cops who have violated either of these laws have been sued WELL into the 7 figures.
We have a constitution for a reason. I absolutely support the Trump administration removing all illegal aliens. But I DO NOT SUPPORT them violating rights to do it. If they KNOW someone is here illegally, go snatch them up. But don't just walk up to some Hugo Rodrigues on the sidewalk and tell him he has to prove he's here legally. That's not the way it works.
