USDA Inspector General Physically Removed by Security After Refusing to Comply with Her Firing

Civil servants are protected, not just through laws, regulations, or collective bargaining agreements but by the 5th and 14th Amendments of the Constitution.
Not following the law will cost more and it demonstrates a lack of respect for the law as well as civil servants. Best to be careful with insults when you're wrong, pinhead.

"President Reagan’s Removal of All Inspectors
General

During presidential transitions, turnover of most political
appointees is the norm. New Presidents have the authority
to remove IGs at the start of their Administrations and make
their own nominations.
However, following such action at
the start of the Reagan Administration, practice has
disfavored removal of IGs during presidential transitions."

It's your Constitution Chump will be fucking prison style when your lube runs out. Doesn't worry me, I think the Constitution is one of the worst founding documents I can think of.

I am here to enjoy the MAGAt hypocrisy as they wrap themselves around defence of the Constitution while fluffing Chump as he fucks it.

What are your favorite documents?

"The Trump administration has a pretty strong argument that the notice provision is unconstitutional. The Court has recognized the president’s “unrestricted removal power” over executive branch officials, subject to only “two exceptions.” The potentially relevant exception here comes from the shriveled and maybe-dead precedent of Morrison v. Olson (1988). There the Court ruled that the removal protections on the old independent counsel didn’t unduly interfere with the functioning of the Executive Branch because “the independent counsel [was] an inferior officer under the Appointments Clause, with limited jurisdiction and tenure and lacking policymaking or significant administrative authority.”

For reasons explained in this paper by Ari Spitzer, an inspector general is probably an inferior officer under the Court’s appointments clause cases. The main reason is that the IG must “report to and be under the general supervision of the head of the establishment involved.”

The president can remove an inferior officer, under Seila Law’s interpretation of Morrison, unless the officer has “limited duties and no policymaking or administrative authority.” I agree with Spitzer that an IG probably exceeds this standard. IGs in some respects have narrower powers than the independent counsel that was deemed constitutional. They cannot prosecute, for example. But in other dimensions—indefinite tenure and expansive jurisdiction and freedom to initiate an audit or investigation—their powers can be seen as broader than the independent counsel’s. "

You bet. And she'll win. Is this what you voted for? Dragging civil servants out without due process? What's next on your "accept" list? Dragging a couple out and shooting them to speed up the process? Is that what you voted for?
I wrote in for President, so like the Great Kenyan Prophet, I cast my vote as "Present"......well technically it was for Peanut the murdered squirrel but in Virginia it is the same as voting "present" as write-in for POTUS generally don't count

And that's done by giving Congress 30 days notice and cause, Shirley? Unless you think US law doesn't apply to Chump.

O’Bama didn’t give congress ANY notice of the secret ransom he paid to the State Sponsor of Terrorism to release 8 hostages. It was even done in the dead of night.

"USDA Inspector General Physically Removed by Security After Refusing to Comply with Her Firing
Now Reuters revealed today that security agents physically removed the inspector general of the U.S. Department of Agriculture from her office on Monday after she defied the Trump White House following her firing.

Phyllis Fong, a 22-year veteran of the USDA, told colleagues that she had no intention of leaving her post after the White House terminated her, claiming Trump had not followed proper procedure.

Reuters reviewed an email by Fong in which she stated the independent Council of the Inspectors General on Integrity and Efficiency “has taken the position that these termination notices do not comply with the requirements set out in law and therefore are not effective at this time.”"

LOL!! Sounds like her little insurrection didn't last long. She could always help Dr. Jill with the diaper changes.
Glorious. Absolutely glorious. The more lefties we fire and arrest, the better.
