I like it....Sort of a end-around using a law that is already on the books.

Break it off in them Trump! :)

LMAO. You get back to me when they actually file some charges.

Seeing as how you think we're all "Nazis" and "fascists", we don't need no stinking "charges."

Just lock them up on general principles. Send heavily-armed FBI agents to their homes at 3AM, and don't forget to tip off FOX News first.

Not all are Fascists. Just the ones that think "we don't need no stinking "charges."

Odd, you had no problem with Biden's DOJ doing it to Trump.

He was locked up with no charges? I don't think so. Got a link?

Oh come on, Trump mishandled classified material and committed fraud on numerous occasions. I mean do you people even think for a damn moment. We are talking about companies, hiring managers, human resource directors. Now they got to worry about some Karen or male version thereof that they don't hire. Tariffs have already "paralyzed" the labor market, think this is going to help.

And the department of Justice has been gutted, especially the Civil Rights Division, which is why I posted LOL. Besides, what happened to allowing companies to make their own hiring decisions. I mean do we really want the federal government jumping in? What do they look for, quotas? And the federal government can better determine a qualified job applicant than the company itself?

LOL....You must be unfamiliar with the HR weenies of the last couple decades.

You know, they are the same ones that were hiring illegals no end.

Interesting. How would this be fraud crime? Any detail?
The False Claims Act (FCA) is being utilized by the DOJ to investigate and enforce compliance with federal anti-discrimination laws in relation to Diversity, Equity, and Inclusion (DEI) programs, particularly among federal contractors.

Overview

The Department of Justice (DOJ) has announced a new initiative to employ the False Claims Act as part of its efforts to address what it perceives as illegal DEI policies. This initiative is primarily aimed at universities and federal contractors that receive federal funding. The DOJ's "Civil Rights Fraud Initiative" seeks to investigate and pursue claims against entities that knowingly violate civil rights laws while receiving federal funds.

Key

The executive order, titled "Ending Illegal Discrimination and Restoring Merit-Based Opportunity," prohibits the use of race, gender, or other protected-class preferences in hiring and contracting decisions. Federal contractors and grant recipients must certify compliance with anti-discrimination laws, emphasizing merit-based hiring practices. Failure to comply with these requirements could lead to FCA liability.

Implications

Organizations that operate DEI programs may face increased scrutiny under the FCA. If a contractor certifies compliance with anti-discrimination laws while continuing to implement DEI practices that the government later deems illegal, they could be liable for submitting false claims. This includes potential misrepresentations in DEI reporting and false certifications regarding compliance with federal laws.

Whistleblower

The FCA allows private individuals, known as whistleblowers, to file lawsuits on behalf of the government if they have knowledge of violations. This could empower employees or competitors to bring qui tam actions against organizations they believe are noncompliant with the new DEI-related requirements.

Conclusion

The DOJ's initiative to leverage the False Claims Act against DEI programs marks a significant shift in federal enforcement priorities. Organizations that receive federal funding must carefully assess their DEI initiatives to mitigate legal exposure and ensure compliance with the new regulations. As the landscape evolves, it is crucial for businesses and contractors to stay informed about their obligations under the FCA and the implications of the executive order on their DEI practices.

From what I can gather it's sort of like when Al Capone was set to prison on tax evasion charges....There's more than one way to skin the DEI cat. ;)

I see you got an adequate answer but let me add some context.

Normally, what we are talking about here, is a company, with a government contract, often times awarded under DEI programs like contracts reserved for minority owned businesses, must comply with the requirements and cannot be created specifically for the purpose of gaining the contract.

The purpose of the False Claims Act was to target companies that were mere pass throughs, created simply to qualify for the contract. Minority owned, on paper, but generating no real value and creating no wealth for the minority community. Of course, now there are no DEI programs regarding awarding government contracts. I guess they got to have something to do.

Now, the False Claims Act is being turned on it's head. Now, it is being used, like a sledgehammer, to constrict any company doing business with the government, hiring decisions. This opens these companies up to the federal government subpoenaing their hiring records.
