Update....BREAKING NEWS! Universal Background Checks are now enjoined! No background checks for private gun sales in Virginia! 10/29/25

/----/ I have three children, and I would never put them in a situation where they could get in trouble, no matter how remote. Do it legally.
Assuming you aren't talking about a firearm purchased from an FFL after the UBC date, as long as no one talks, the state can't prove anything.

/----/ Again, I would do everything on the up-and-up when it comes to my kids.

That's fine -- my entire point was that without registration, UBCs are uselessly impossible to enforce.
The anti-gun loons know this of course -- UBC is nothing but a vehicle for UGR.
And no one wonders why they want that.

Sure.
How does that prove you gave your rifle to one of your adult children after the UBC requirement was in place?
What if you have a gun you did not buy from a FFL with no paper trail leading to you? Same question.
That's the thing, after the 29th I don't have to prove shit....All I have to say is I sold/traded it to someone that was not a prohibited person as far as I knew.

There's no stipulation about how one comes to that conclusion and you don't have to say if asked.

The only guns with no paper trail are the ones manufactured before 1968 (no federal reporting requirement at the point of sale) unless they have passed through an FFL since then.

Think your granddad's pre-68 Colt revolver he bought at the local hardware store in 1955 and kept in the sock drawer....That revolver will have a very limited paper trail.

Now because Colts are all serialed the closest thing to a trail would be a factory letter stating when it left the factory and where it was shipped to. The trail ends right there.

That said some states (like NY) had a point of sale reporting requirement to the state before '68 but that is another subject.

In VA you can give a firearm to an immediate family member as a gift without a UBC as long as the individual can legally own one in VA and you both are VA residents.

That also includes wills.

Prior to 2020 private sales without UBCs were legal in VA so there are probably plenty out there without a paper trail.
