They are being released if their alleged crimes allow them to be released on bail or whatever that is equal to all persons being charged for that crime, until they go to trial.

If you shop lifted and a citizen can be released on bail until their trial, then so can any person charged with that specific crime.

The judge does not get to change the law written....for when release is allowed under their State laws.
