If he had cooperated with them in June, they wouldn't have raided his estate to get 11 sets of documents. Keep in mind, if the FBI/DOJ had done its job, they would have made Trump sign a statement basically saying for the record that he had produced all the documents that they'd requested.

He could claim that "Whoops, I had no idea those boxes were there." He could do that. But someone knew those documents were in his estate. Someone knew - but he didn't? Possible, but not plausible.

That leads me to a question I've been kicking around in my head this afternoon: is someone close to Donald wearing a wire, because if that's the case, he is well and truly fucked.

What happens if there is a document there that he wasn't supposed to have? His defense could easily be that he wasn't the person that took it. Now, the Left-BI planned it so he wasn't home at the time, when his lawyer arrived to find out WTF was going on, she started to oversee the process and they ordered her out of the house. They instructed that all security cameras be turned off.

Who would a judge or jury side with if such a case were made?

I do agree with you that slime ball Garland doesn't want to prosecute him. His instructions are to make sure Trump can never run for President again because the commies are scared to death of him.
 
Tulsi has some good and bad positions. Her Russia leanings has me suspect regarding her intentions though. Above all she’s an opportunist as evident by the right wing pandering she does. I think she just wants to be famous - she’s got a career doing that.

I wouldn't say she did a great job, but for her first time, very good. She was a bit nervous which is to be expected. I think if they let her fill in more often she will really get the hang of it.

I swore an oath to support and defend the Constitution against all enemies, foreign and domestic.

Most Republicans are clearly domestic enemies of the Constituion, therefore I am oath-bound to oppose them.

I do not have a choice in the matter. My sacred oath binds my actions.

That means I won't stop just because the traitors cry at me, or fling more death threats at me.

My cousin is a truck driver, has been one for years and years. One of the best people to talk to and I have no reason to think he's an outlier. He listens to a ton of talk radio, podcasts and books on tape while on the road and has seen almost all of the country. When he stops, he always talks to a lot of people. Pretty cool imo.

Not quite. Not sure where you're getting your info from, but it's not accurate. The president *does* decide what is classified, and what is not classified. But he doesn't just change the process for classification, which is a highly regulated process by statute and regulations.

That's probably his best defense, and that probably would have worked in June when they initiated the subpoena. As I said earlier though, that's a bit harder now. When the government requests possible evidence of a crime - simply possessing classified evidence in an unsecured environment is a crime, ipso facto - then they don't just show up, ask for the documents, and rush off to the donut shop no questions asked. There are forms to fill out, which if completed falsely constitute crimes independent of the classified information.

What I am saying is that unless the agents who executed the recovery of the documents back in June didn't do their job - which is indeed possible I suppose but unlikely - then Trump would have had to sign some forms pledging that, to the best of his knowledge, he has turned over all classified information, and more specifically, all the documents the Archives had requested. I could see one 'oopsie', but it's hard to argue 'whoops' now.

I suspect the 'strategy', if there is one, is to let the state AGs make their first move, let the Jan 6 Committee continue to make the case to the American people, and then hope like hell that Americans vote against Repubs in November, which is not likely to happen, admittedly, though more likely than it was 3 months ago.

Yes they can stop him. Section 2071 of Title 18 of the United States Code.

You have to be a sitting president to issue an executive order. He can't just issue an EO now, and in the absence of an EO prior to his departure, that's a problem.

But I agree with what the Politifact article you linked to said. In summary, this is an unprecedented case, and in terms of what the law and constitution say about a former president's relationship with classified or other privileged information, there are a lot of known unknowns, and some unknown unknowns as well, to use Donald Rumsfeld speak.

I'm quite sure his team at the White House are the people who packed those documents. I'm also sure his legal team at home went through them again once the FBI became involved. Either way, the main goal is to stop him from running, and potentially tarnish his name to limit the damage of the people he supported for Congress this November. It doesn't matter if what they say is true or not, only that he is discredited.

However it was a bad calculation. The public is about sick of these stunts and the damage being done to the Democrats is self-inflicted. The 1/6 commission is a joke, and they have to find another means to try and stop the Trump train. In my state some pissed off kook tried to get into a FBI headquarters likely to kill agents. They can't keep pushing this bullshit, and it is bullshit. This move by the Biden administration is history in the making, and they got some lowly magistrate to sign this search? Too many things don't add up.
 
Tulsi's guest James Gagliano (Retired FBI agent) said that even if Trump had classified documents, they still have to prove intent to commit a crime. Seeing as how Trump had nothing to do with packing those boxes and, the fact Trump let them inspect the documents in June, I see no crime here or any legal reason for a FBI raid.
The need to prove a crime was committed is a matter for trial, not when applying for a warrant.
