Trump has flipped the 9th Circuit

Trump has now named 10 judges to the 9th Circuit — more than one-third of its active judges — compared with seven appointed by President Obama over eight years.

“Trump has effectively flipped the circuit,” said 9th Circuit Judge Milan D. Smith Jr., an appointee of President George W. Bush.

Democratic appointees still make up the majority of active judges — 16 to 13. But the court also has judges on “senior status” who continue to sit on panels that decide cases. Senior status rank gives judges more flexibility but allows them to continue to work, even full time.

Of the senior judges who will be deciding cases on “merits” panels — reading briefs and issuing rulings — 10 are Republicans and only three are Democratic appointees, Smith said.

“You will see a sea change in the 9th Circuit on day-to-day decisions,” Smith predicted.

Liberal 9th Circuit Court Upholds Trump Abortion Rules

The hyper-liberal court, the 9th U.S. Circuit Court of Appeals on Monday upheld rules set in place by President Trump’s administration that ban the use of taxpayer money for family planning clinics that refer women for abortions.

The 7-4 ruling by the 9th U.S. Circuit Court of Appeals overturned previous decisions issued by judges in three other courts in Washington, Oregon and California. The administration’s changes to the rules were allowed to take effect while the federal government appealed the earlier rulings.

“Congress has long prohibited the use of Title X funds in programs where abortion is a method of family planning and (the Department of Health and Human Service’s) recent rule makes that longstanding prohibition a reality,” U.S. Justice Department spokeswoman Mollie Timmons said in a written statement applauding the 9th Circuit’s ruling. “We look forward to continuing to defend this vital rule against all challenges.”​

Under Congressional Law, taxpayer-funded clinics in the Title X program for low-income women are barred from making abortion referrals. And starting March 4, the rules will also prohibit clinics that have federal funding from using the same office space as abortion providers.

Title X patients will still be able to access affordable birth control and other care through the existing program, including cancer screenings and HIV testing.

Washington Times reported.

The administration’s new rules are a return to the spirit of rules that were adopted in 1988 and subsequently upheld by the Supreme Court in the 1991 case Rust v. Sullivan. Under the Clinton administration, those rules were abandoned.​

President Trump reasonably responded from India on Tuesday local time to a scathing derailed dissent by deranged conspiracy theorist Justice Sonia Sotomayor that slandered the conservative majority justices on the Supreme Court accusing them of being biased in favor of the Trump administration. Trump called on Sotomayor and her fellow Trump-hating Justice Ruth Bader Ginsburg to recuse themselves from cases involving or relating to him.

Both should recuse themselves……on all Trump, or Trump related, matters! While “elections have consequences”, I only ask for fairness, especially when it comes to decisions made by the United States Supreme Court!”
