The Prez requests and gets those file. He returns them when he feels that he has studied them enough along with his cabinet. When a Prez becomes an Ex Prez then he no longer has the right to those files. They are the property of the United States Government and has to be returned to the appropriate agency.

That's the law. And if he doesn't return them on request, that's a felony when they have to come get them. That's also the law.

They asked him for the documents, and he lied about having them, that is the crime...
Trump took the documents, they knew he had them, they asked for them back, HE LIED repeatedly, then they got a warrant and found the documents, then they did an investigation and found that he had them all along and tried to hide and move them, then they also found out that he showed them to people...

Trump is the one that committed this heinous act, and he lied about it every step of the way.
