The President of the United States does not have the authority to eliminate the Department of Education on their own. The power to create, abolish, or reorganize federal agencies, including the Department of Education, typically requires an act of Congress1. However, the President can propose such changes and work with Congress to get the necessary legislation passed.

Much of what the Department does is legitimate and will be transferred to other departments. Remember the Department of Health, Education, and Welfare?

College grants and loans will be handled by somebody else, not eliminated. Funding for specific programs will continue. It has been suggested that the money for these programs will simply be converted to "block grants" that will be distributed around the country according to student populations.

The Trump administration has begun drafting an executive order that would kick off the process of eliminating the Department of Education, the latest move by President Donald Trump to swiftly carry out his campaign promises, two sources familiar with the plans told CNN.
The move would come in two parts, the sources said. The order would direct the secretary of Education to create a plan to diminish the department through executive action.
Trump would also push for Congress to pass legislation to end the department, as those working on the order acknowledge that shuttering the department would require Congress’ involvement.
The president said Tuesday he wants his secretary of Education pick, Linda McMahon, to “put herself out of a job.”
“I told Linda, ‘Linda, I hope you do a great job in putting yourself out of a job.’ I want her to put herself out of a job – Education Department,” Trump said.

The federal department of education was created with an executive order. Its demise at the pen of another president is both fitting and poetic justice.
Be prepared to hear and see "Randi" Weingarten rant, rave and do head stands, then tell us it's all for the children.
Glad that Trump Trump is trying to do something about it, while Neo-Marxist Democrats will fight him every step of the way. Tax and spend is their MO.
American kids should be out marching today for this. Not for the freeloading bastard invaders burning American flags.
Why is it that the U.S. spends more per child for education in K thru 12 than any other nation and our children cannot read reading, writing or math standards? Government bureaucrat interference has made our children more unIntelligent in school learning.
