This is the second attempt to ban the National Democratic Party of Germany. The bid to ban the party is proudly presented by other parties. The first attempt failed over ten years ago because it was liaisons of the German domestic intelligence that provided the alleged evidence for the unconstitutional nature of the NPD. This new attempt bases on accusations stating the party is "racist, xenophobic and anti-Semitic". However, nothing can be "unconstitutional" in Germany as the country lacks of a constitution. The German "basic law", an improvised constitution, denies itself that it is a constitution and demands a democratic legitimated German constitution, that no German government since the creation of the FRG has ever made a start on. A ban of the party would represent a violation of the basic law and democratic principles.
Art. 146:
This Basic Law, which since the achievement of the unity and freedom of Germany applies to the entire German people, shall cease to apply on the day on which a constitution freely adopted by the German people takes effect.
