Essayli Ruled Ineligible​

In what is now the third such ruling, a federal judge disqualified Bill Essayli as acting U.S. attorney in Los Angeles, ruling that his appointment was a Trump administration workaround that violated federal law.

Essayli has been ineligible for the post since the end of July, concluded U.S. District Judge J. Michael Seabright of Hawaii, who was brought in to the hear the challenge because local district judges have the power under one statutory scheme to appointment acting U.S. attorneys.

The decision follows similar rulings against Alina Habba in New Jersey and Sigal Chattah in Nevada that have thwarted a Trump White House effort to install loyalists and avoid or at least delay the toils of Senate confirmation.

The latest ruling has major implications for the corrupt political prosecutions of former FBI Director James Comey and New York Attorney General Letitia James, who are both challenging on similar grounds the appointment of Lindsey Halligan as U.S. attorney for the Eastern District of Virginia.

A senior federal prosecutor in Virginia was fired after a disagreement about whether he would take charge of the Trump administration’s effort to re-indict James B. Comey, according to multiple people familiar with the matter.

The prosecutor, Robert K. McBride, had been working in the U.S. attorney’s office for the Eastern District of Virginia for only a couple of months. His firing is the latest development in the fallout in the Justice Department over President Trump’s effort to punish Mr. Comey, the former F.B.I. director and his longtime nemesis, whom the president blames for past investigations of his conduct.

Mr. McBride had been serving as the top deputy to Lindsey Halligan, a temporary assignment after he spent more than a decade as a federal prosecutor in Kentucky. The Trump administration made Ms. Halligan the U.S. attorney overseeing that prosecutor’s office last year.

The administration has tried to restart the Comey prosecution and wanted Mr. McBride to lead that effort, according to people familiar with the matter who spoke on the condition of anonymity to describe internal discussions. The Trump administration’s slapdash immigration enforcement keeps causing federal judges to speak out.

One of the most prominent recent examples came from Minnesota, where a conservative judge demanded that the acting U.S. immigration chief explain why he shouldn’t be held in contempt. In that case, Chief U.S. District Judge Patrick Schiltz went out of his way to note that he wasn’t upset with the government lawyers, who he wrote “have struggled mightily to ensure” that officials comply with court orders.

A similarly scathing ruling just came out of Florida, but in that case, the judge ordered the lawyers involved to explain why they shouldn’t be sanctioned.

Like Schiltz’s order in Minnesota, U.S. District Judge Roy Dalton’s ruling in Florida stemmed from the detention of an immigrant. In the latter case, the Obama-appointed Dalton had ordered the release of a high school student named Javier Gimenez Rivero, who had been living in Florida with his family for more than four years after they fled Venezuela. On Monday, Dalton published an order memorializing what he said during a hearing last week when he ordered Gimenez Rivero’s release.

The FBI executed a search warrant Wednesday at the Fulton County Elections Hub and Operation Center near Atlanta, as part of a criminal investigation into records from the 2020 presidential election. Authorities seized 700 boxes related to the county’s 2020 general election.

Brown was appointed to oversee all investigations and personnel in Georgia last February. The Associated Press reported that the FBI moved to replace him last week.
