Putting aside that this was never implemented because it was an election year stunt, not actual policymaking, the legal authority of this hypothetical policy absolutely derives from the ACA. That EO directed HHS to try implementing Most Favored Nation by testing a payment model through the Center for Medicaid and Medicaid Innovation ("consistent with section 1315a(b)(2)(A) of title 42, United States Code")

What gives HHS the authority to test new payment models? What created the Center for Medicare and Medicaid Innovation? Where did section 1315a come from? ACA, ACA, ACA.

If his stupid ACA repeal attempts had succeeded, or the SCOTUS had heeded his request to throw out the entire law, there'd be no authority for anything like this. Same with hospital price transparency. What little agenda he actually had was entirely dependent on the ACA being in place.

Introduce multi-seat preference voting, this will ensure the center keeps power and extremes are kept at bay
Reinstate The fairness Doctrine and bring back sanity to the media.

The US Constitution vest Executive power in a President, that's where the President gets authority to issues EOs over the executive branch, including HHS.

Yes it never happened because the XIden admin pulled the most favored nation status after lawsuits from drug manufactors

No kidding he can put instructions in writing, but policy pursued by the executive branch must be rooted in statutory authority. The President can’t just say he wants to implement MFN or hospital price transparency, there has to be a statutory authority from which those policies derive. (That’s why Trump’s pretense that he could ban pre-existing conditions via EO in the event the ACA were destroyed was a joke.) In this case, the Affordable Care Act is what allows the executive to even contemplate implementing such policies.
