The Supreme Courts Ruling Killing Affirmative Action Might Not Turn Out The Way Conservatives Think

As Jennifer Rubin, writing for the Washington Post, points out, Chief Justice Roberts, author of the majority opinion in the case of Students for Fair Admissions, Inc. v. President and Fellows of Harvard College, eviscerating the use of race-based factors for consideration in college admissions, left a giant loophole, possibly unintentionally, in his esteemed legal reasoning.


As Rubin notes, this essentially allows racism to be put front and center before a college admissions committee without the student’s “race” per se being a factor. So, any savvy college admissions team will still be able to evaluate a prospective applicant based on the racism he or she experienced, if that student is able to work that experience into a college essay response. Under Roberts’ formulation, then, being profiled by racist police officers, being followed around in a department store for no apparent reason, growing up in a poorer neighborhood because of historical redlining and “steering” by racist realtors, in fact just about all of the daily, lifelong indignities inflicted on racial minorities by white people and racist white institutions can be massaged into a college application tying racial discrimination to the applicant’s personal development, inspiration, or goals. And college admissions teams can still base their decisions to admit a person on that basis.

As Rubin observes, “Put simply, as long as you allow students to tell their personal story of racism, race will get considered in the admissions process — to the chagrin of the right-wing justices and politicians who cheer this Pyrrhic victory.”

I don’t think anyone is under the delusion that people will not attempt to cheat the system and that colleges will defy the law. HS counselors will tell every nonwhite student to tell a story of overcoming racism whether they have or haven’t. And at some point everyone will just put that in their essay white, black, whatever.

What I’m confused by is the thinking that college admissions or competition for jobs or whatever based on everything about a candidate’s accomplishments and achievements leaving out all their immutable characteristics is somehow racist and a bad thing.

This will turn into a massive victimhood perspective, where high school black students will devote their time not to achieving but seeking out examples of how they were wronged.
 
Some modern day people for some reason, actually do carry "guilt" for acts they had nothing to do with and going back to before their great, great grand parents were born. This coulc be they type people on the entrance boards of many "Liberal" Arts colleges and University. That ruling basically said, they did not have to take it into account, but purposely left that loophole open.
Here are some supremely guilt ridden white people from Maryland, during the George Floyd protests. A BLM street preacher had people bowing down to and washing feet of black people. I saw this as a live report at the time. Some were even crying, due to their guilt. It was the most impressive manipulation in mass I have ever seen. The Psyops people could take lessons from the guy. It was spooky to watch.

No argument on being over the top. I maintain though that affirmative action on college admissions is a separate issue.

A full 28% of admissions to the most prestigious universities, are solely due to rich parent donors, or legacy parents whose names appear on buildings.

If you’re going to do away with affirmative action based upon non discriminatory policy, then you can’t have it both ways.

I have no problem personally with the courts ruling, if it is going to be applied evenly across the board, meaning no special consideration for rich white kids, or poor black kids.

In my own opinion, you should get admitted into a prestigious university based solely upon your grades, and participation during your high school years, or you’re a one in a million gifted 10 year old.

University administrators will always find ways to admit unqualified Negroes. Those Negroes will drop out, flunk out, or get useless degrees in majors like black studies. The Universities will still deposit their tuition money in the bank, brag about having a student body that "looks like America," and continue the scam.

We need to end affirmative action in hiring decisions. Most hiring managers do not like to be pressured by the government to hire blacks who cannot perform adequately.

Before the civil rights movement Orientals in the South were often considered to be "honorary whites" because they behaved and performed at least as well as most whites. That is why they were rarely discriminated against.

And here we go.

First, I doubt that the justices will be chagrined as they wrote the decision that allows this to take place. It seems that someone has an ax to grind. So good luck with that.

Second, whites and asians will have no problem buffaloing their entrance appliactions to compete with the B.S. that is going to show up on the applications of others. And consider that unless there is a police report associated with some claim, they can't be considered as they'll wind up in court REAL FAST. To think otherwise is silly.

Third, why does it gall you so much to see injustice corrected ? Qualified kids are being excluded on the basis of race (meaning they are out so others, less qualified, of a particular race can be admitted). The ideal in this country is merit. Why do you seem so against that ?

Wonder why the whole left wing had to change their underwear after the ruling if admissions boards are still going to be racist.

One thing I learned from all this is that Joy Reid went to Harvard. I couldn't contain my laughter. She said she got in because of affirmative action....proving that we often send the wrong people to good schools for stupid reasons. She's not Harvard material because she's black. She's not Harvard material because she's stupid.

Of course she got something like a film degree which is what qualifies her to be a left wing pundit.

Good luck touting the idea that affirmative action will continue to keep qualified students out what people like Reid get in.
