Board members may or may not know Johnson will not seat a recently elected Dem (special election in AZ) claiming it breaks with protocol to do so when the House is not in official session. However........

Earlier, before Johnson emerged from his office, Gallego told reporters: "I mean, again, he's already rejecting a duly-elected member of Congress. Now, can we really imagine him going one step forward and actually doing a compromise that's going to extend — at least to some period — the Affordable Health Care Act?"
"The line — everything keeps changing. Like it's every day, some new excuse why he won't sign, right? Look at the core. He knows that, that is the deciding signature on the discharge petition," Gallego added.
The Arizona senators also pointed to the fact that Florida GOP Reps. Randy Fine and Jimmy Patronis were sworn in while the House was out of session in April. Both were elected in special elections, like Grijalva.

Here's the thing. Grijalva has already stated she will sign the discharge petition calling for a vote to force the release of the Epstein file. Hers is the deciding 218th vote needed for the petition to pass.
However, there's a House rule stating until the 218 vote threshold has been reached, congressmen who have signed the petition can change their vote. They are not locked in. So until Grijalva is sworn in and casts her vote Johnson has time to pressure the four Repubs who are on board with passage to change their vote.
Moreover, if at all possible he wants to avoid a floor vote so Repubs not in support of the petition do not have to be on the official record as having opposed it. Cuz, you know, a majority of Repub voters are in favor of passing it. Maybe a larger majority now that the blonde sock puppet was asked about the existence of photographs reportedly showing trump with topless young women.
