Why did he appear before a judge in the first place?

This is just a wild guess but maybe it was because apparently officers and prosecutors also believe, based on the evidence they have, that the killing was unlawful.

If he was within the law, the system will reveal that in time.

Got a link? Last I heard, he's facing a grand jury but hasn't been indicted. A criminal referral isn't necessarily unusual in this situation - he did kill someone after all. I personally doubt he'll get charged, but who knows. If he gets charged, I find it very hard to believe he'd get convicted - I'm pretty sure robbery (fake gun or real one) is a felony and IIRC, Texas allows armed citizens to shoot people committing forcible felonies. IANAL, though.
