You might want to check NY laws, a person in not considered convicted until the process is complete, that means the defendant has to be sentenced. That hasn't happened and considering the SCOTUS decision, it may never happen. The Judge is due to rule on that on the 18th. It might be a way for the judge to save face and not have the case overturned.
