Adding more seats to the court, however, for the sole purpose of bumping up the number of ideological appointments is not, and FDR was rightly slapped down for trying. No it isn't. The judicial filibuster was removed by HARRY REID and he was warned at the time by republicans that it would come back to haunt the democrats. There is nothing in law or the constitution determining the process for vetting a president's nomination of judges or justices. The party in control of the senate makes up the procedure to suit itself. The democrats trashed all the traditional rules when they had control to setup an advantage for themselves. The republicans are simply playing the same game. Nineteen justices have been proposed in election years, seventeen of them were confirmed, and at least two were confirmed after the controlling party LOST the election. All Obama had to do to fill empty judge seats was to propose judges and justices that were acceptable to the party in control of the senate. That had been done hundreds of times before. He refused to do so. During the Obama presidency the democrats decided to play hardball and it cost them the senate in 2014, even more seats in 2016 and the presidency in 2016. What sticks in your craw is that the democrats have been stacking the courts with liberal judges and justices for over eighty years and the republicans went along to keep the peace. The republicans finally learned that the old saying "if you pay the Danegeld, you never get rid of the Dane" is true and stopped playing nice.
