It’s all good. It was quite predictable that SCOTUS wouldn’t prevent the sentence from being imposed. In fact, I predicted it.

They most often decline to take a case where the litigation isn’t finished. They usually prefer to weigh in only after there is a “complete” record. The sentencing allowed entry of judgment to be made and with that there is now a complete record.

So, Trump be required to go through the motions of the State’s appellate process. That’s probably pointless, since it’s NY.

But, then, the appeal (now on a complete appellate record) can go to SCOTUS.

THIS CASE is — and has been — a miscarriage of justice and a deliberate mockery of laws, rules and procedures. It will get reversed and dismissed.

This is all true, but Trump was not asking for a ruling in the case- he was asking for a stay so that the interlocutory appeal could be heard before sentencing.

Merchan delayed ruling on that motion for 5 months, and then denied it at the last minute and set sentencing for 5 days later.

He effectively denied Trump the interlocutory appeal, and the SCOTUS could have prevented that- 4 Justices saw it that way.

Roberts was afraid of looking political, and he chose to let the sentencing go ahead since Merchan had already said it would be an unconditional discharge. That might be convenient, but it does not enforce due process.
