“The only date in the Constitution is January 20, so we have more than enough time to right the wrong of this fraudulent election and certify Donald Trump as the winner of the election,” Miller said during the interview.​

The problem with that theory is that 3 USC 5, and the electoral college vote on a date set by congress, pretty much locks in the results from the December 14th vote, and counted as cast on January 6th.

Actually he can be "arrested" for trespass, and removed to the nearest jail. They can request he leave, but they can't forcibly remove him, until he is subject to arrest.

I believe it's all about Trumps fundraising. This way his supporters will continue to contribute money, all the way up until January 20th. As of last week Trump was already up to $250 million raised, of which the majority can be used by Trump for non-election purposes. Like paying off personal debts.
